Historic ART and surrogacy reforms introduced in WA

Western Australia’s assisted reproductive laws are set for a major overhaul, with the Cook Government introducing the Assisted Reproductive Technology and Surrogacy Bill 2025 to State Parliament this week.

The reforms will expand access to assisted reproductive technology (ART) and surrogacy to same-sex couples, single people, and transgender and intersex Western Australians, removing long-standing barriers and aligning WA with Victoria, South Australia, New South Wales, the ACT and Queensland.

Premier Roger Cook described it as “a historic week for our State and one that many Western Australians have been waiting for,” adding the Bill would “streamline and modernise WA’s assisted reproductive laws, making it easier for many Western Australians to start a family of their own.”

The legislation retains safety and quality safeguards, including licensing of fertility clinics by the Department of Health, and will strengthen rights for donor-conceived people to access information about their genetic heritage where records are available.

“This legislation delivers on my government’s commitment to modern, inclusive and evidence-based laws that reflect the needs of our community,” the Premier said.
